OEM versions of programs (e.g., WinXP) are sold to Original Equipment Manufacturers (OEM) to be "given" away with the sale of their product--MAYBE a computer. (thus it is being "transferred" from the OEM to the user.) True, the "distributor" license that the OEM has may not be saleable, but the OEM program W/license (and it certainly is "registerable") and its related (usually) hardware is saleable--that is the whole purpose of a manuracturer buying the OEM versions from, eg., MS. (When you buy a Dell and it comes with an WinXP OEM disk, are you buying the OEM disk, the computer, or both? Why quibble?) The tied in hardware does NOT have to be a computer--it's whatever hardware the OEM tied the software to. Granted this may be abused by some OEMs who have a number of surplus disks, but MS knows what's going on (on Ebay or anywhere else), and if they really objected to it, they would come down quickly on the abusing OEM. So, if you can find an OEM version (make sure you get its "key"), it is "buyable" and to be strickly legit., you will also get whatever piece of hardware the OEM tied it to, to abide by the letter of his agreement. It definitely is NOT PIRATED! So, if you buy an OEM XP, along with its related cable (a cable is hardware, too, isn't it?) for $50, are you buying the cable, the OEM or both? Now, this may not be the way the system "ought to work", but it is the way it works. And as long as MS allows it to work, I see no reason why it should not be used...as millions have done. It is a matter of individual choice. Note: this is not a new subject. Rather it has been hashed and rehashed many times in the forums and the final word is always as above. Also, 'USED" software is re-saleable. As long as you remove the installed program from your computer, there is nothing to prevent you from selling the installation package to someone else.
