Election Aspirant Moves HC Swati Deshpande I TNN Mumbai: The two-child restriction on contestants in civic elections ought to be suspended when one child is physically or mentally challenged, said a poll aspirant from Pune in a new petition before the Bombay high court. With India's population at 1.2 billion and rising, the rule introduced first in 2000-01 for reigning in the national population has also run its course and is now "redundant", says Suresh Shirude, whose petition the HC on Tuesday posted for a hearing next Monday. The challenge is to Section 10 (1)(i) of the Bombay Provincial Municipal Corporation Act, that was introduced in 2000 to the 1949 law. It added a rule for disqualification of a contestants to municipal corporation, councils and other local bodies. Shirude's lawyers from the law firm, ALMT Legal, state that the rule is discriminatory and arbitrary besides impinging on a citizen's right to life. Shirude has three children-the oldest is 21 and the youngest eight years old. His middle child, a boy (18), is blind from birth and when doctors gave up hope, he and his wife decided to bring in to the world a sibling for his support. "The decision to have a third child was to secure the wellbeing of our blind child and in the interest of his family," Shirude says. With nominations to be filed by January 2010 for the February elections in Pune to the civic body, Shirude's writ says the two-child rule must make an exemption in case of "special children". BJP leaders, including Eknath Khadse, also wrote to the chief minister with a request to suspend the rule in special circumstances such as accidental birth due to failed birth control methods and children with disabilities. The writ wants the HC to read down the rule in such a manner as to protect the right to life of not only the aspirant "but also his challenged child". The petition says the Indian population in 1991-2001 was 846 million and that there was an increase of 180.6 million population in the decade. Then, the two-child rule kicked in almost nationwide in 2000-01. And in March 2011, the population touched 1.2 billion with a rise of 181 million since 2001. Thus, the provision should be struck off, it says. But population experts say the idea has worked since its enforcement -in some states six years ago-to keep many political activists and aspirants in control.
