Might be worth getting the tower and parcel given to you, then make a decent
offer for an additional lease area around the tower to encompass the guy
anchors. The farmer may be ok with the location of the anchors if he is making
more money. In the end if you get the tower given to you or possibly even be
paid to take it (they have the cost of decommissioning plus they own the parcel
and still have taxes on it so paying you to take it off their hands is still
attractive). Worst case would be you take the existing tower down and replace
it with something that fits on the parcel. There could also be the issue that
the farmer just doesn’t like the current owner and you being somewhat local he
may have a change of heart to support local business. I would work this a
little harder and see if you can’t take it in a different direction that the
situation as it stands.

Thank You,

Brian Webster

I looked up on the property records who's parcel of land that tower is on and
was able to google search a name and find a phone number and called it. Long
story short the tower is on its own parcel of land but the guy wires go into a
neighbors field and they messed up the original contract for the easement and
basically the farmer doesn't want to farm around the wires anymore and there
are attorneys involved and the tower company is decided to tear the tower down
since its vacant anyway. Sounds like a mess.

Discounted net present value of future easement payments is an easy figure to
come up with. Then cut it in half and offer it as a one time payment for a
“perpetual easement that runs with the land”.

I have done this a few times. I have had some success converting annual leases
to one time easement payments. If you would like to discuss give me a shout. I
have done both ways. Taking ownership of an abandoned tower from a landowner,
buying a tower cheap and renegotiating land lease, I even got paid to take a
tower once.

I have heard that American Tower is going to be tearing down dormant tower in
my area, is there any reason they would just give this tower away to someone
like me to get out of it? How do i call at ATC to inquire about this?
