I think you need to do a lot more research on the subject to really get a good answer.
Short version: Collecting USF fees from customers is always optional. Paying USF fees is required for services that are subject to USF. There is a deminimus category where you don’t have to pay the fees (your upstream providers pay them) but once you exceed deminimus you have to pay them yourself. Things subject to USF: phone service, voip service, private line service, point-to-point data circuits, point to multipoint data circuits. Things not subject to USF: Internet service provided to a retail or business customer There are a lot of caveats to the ’things subject to USF’ and the lawyers can’t agree on what it is. USAC acts as judge, jury, executioner, and pockets the money. The FCC occasionally weighs in and confuses things more. I don’t believe you are required to be a 499 filer to participate in ACP for broadband service. Not sure what it would have to do with anything.
