No, Elon is not necessarily being hypocritical. I assume he is not saying that all artificial intelligent hardware and/or software should be free, but rather that general knowledge about the power of AI and how to make AI should be widely spread. This so that society, can be better prepared for the great benefits and great threats of the technology, and so no one group or nation will have such a headstart on AI that it could use AI to dominate or accidentally destroy the world. I assume Musk has read Bostrom's book "Superintelligence" which discusses the potential dangers of having one group developing extremely powerful AI that is much more powerful than any possible countervailing AI.
