The software is open-source so i guess you don't argue on the 'openness' of that. If you want a really open/unlocked phone just buy an ADP1-G1!
I'm using it in Switzerland and Italy with a pre-paid SIM (no data plan or stuff like that) Works fine (except for some quirks when roaming..) 3G works fine too in both countries, not that i used it much after activating the phone!
