As I read the current rules (and remember it does say that full rules will be posted later), there is nothing that stops developers doing closed limited betas where a small number of users are recruited into the "team" and test the app which is distributed via email.
This could easily be facilitated via discussions on the android-app-distribution group, or if people wanted, I could have AndAppStore expanded to include a "Looking for testers" section alongside the existing pre-release apps section.
