There are two different things here:
1. Where the 30% goes
2. Whether the user can see paid apps
For me (1) is not as important as (2), its more the principle I
guess :)
In terms of (1) I don't really think this is a tax/legal thing. It
could so easily be part of an agreement between Google and whoever,
for installing the Market app on some device.
In terms of (2), IANAL and so don't know the factors that determine
what taxes should be paid to whom. If its based on where the purchase
was made, then the Network ISO returned by the Network manager would
be the best bet. If its based on user country of residence, then
Google Checkout address would probably be best.
If the Google Checkout address was used then all of a sudden you can
have paid apps available to western expats all over the world. A large
proportion of my (free app) users are US citizens living in non-paid
app countries. So, right now, hardly any of them can see the pro
version.
To recap, this is how it could be:
1. The agreement (between Google and {carrier or manufacturer}) for
installing the Market app dictates where the 30% goes
2. The Google Checkout address dictates whether the user can see paid
apps.
