The other issue is getting payment. My company was advised we had a pretty strong case against a certain french multimedia device manufacturer and we started discussing costs & time frames with the legal advisers. We were told we'd be looking in the mid-five figure range and potentially several years before the matter could be settled (after appeals, etc.), after which we'd still have to get payment from them. We were also told that if they went bust before everything was settled and we'd received payment we'd still be liable for all the court costs.
So things are definately not as simple as the loser pays the winners costs in the English courts.
