You mean someone is using free software within the scope of the license with which it is released? It's not open to anyone's "amazing interpretation" of the GPL, Fritz. ASSP is free open-source software licensed under the GPL, clear and simple.
But it's ok to use your "private builds" as long as you get a piece of the action? ASSP Deluxe for cPanel is using your private beta (it's on 1.3.4(14) currently) and the WHM interface makes no note that it is beta or that it came from your private stash. But ASSP Deluxe is giving you portion of the sales and ASSP X is not.
