Speaking of the moped issue, I recently discovered that the law has changed regarding the limits on what is a moped.  It used to be something like "cannot exceed 30 mph on level ground carrying a 150 pound driver", now the definition has to do with the displacement of the motor.  And apparently, "mopeds" are in the works that fall under this new definition which can exceed speeds of 70 mph. 
 
     Clearly, if we are going to redefine what a moped is, then it is also reasonable to review the other laws regarding mopeds (like the one allowing them to use bike spaces) to ensure their relevance under the new definition.  None of the mopeds I have seen actually need to anchor themselves to a rack in order to secure themselves - the bike spaces that are being used by mopeds are used only because of the convenience they afford. 
 
    In locations where bike parking is in short supply due to this "moped comfort parking", it is likely that bicyclists looking for a secure place to tie their bike are going to resort to doing so in a way that creates a nuisance.  The consequences of pushing the mopeds (that don't need to anchor themselves to a structure) out of the racks are far better than pushing bikes out of the racks.
