Basically. It is considered alive once the head clears. This could be taken as
meaning first breath as the head clearing without breathing is not alive. Of
course, once the head clears medical intervention is possible to help the baby
breath.

Oh, that one has been taken so far out of context that it's gotten silly
already. In the Biblical account, the person died NOT because he 'spilled his
seed' but because he failed to impregnate his dead brothers wife (to give he a
child in the dead brothers name - long story).
