And yet, should one die and not have a proper will, the other may be in a battle with the deceased's family over his share of the property.  Because they union isn't legal, they dont' have the same inheritance rights that other married couples do.  That blows.

  My next door neighbors, both female, have been living together as common law
  marrieds for a number of years, and recently traveled to Mass to get licensed
  and web and then returned home.  Of course this state (Texas) does not recognize
  the "marriage" but they said they did it for symbolic reasons.  They jointly own
  the property, and both are employed as professionals.
