I am also thinking that this case proves out the saying that hard cases make bad law. In effect the United States is starving a woman over the principle of a thing. I am also thinking that perhaps we are seeing a very fundamental problem with the judiciary highlighted -- if you get a bad judge as finder of fact then you can wind up with a decision at odds with the facts, because appeals are limited to procedural matters.
