Ok, Probably not going to be the most popular opinion around here, but I have some personal experience wit this, so here goes.
1. The insurgents and terrorists in Cuba were not in the uniform of a foreign country or power. 2. The insurgents and terrorists in Cuba were not in possession of an official Geneva convention identification card. According to the convention this makes them saboteurs or spies and as such they can be executed without trial. Additionally we did not recognize the Taliban as the government of Afghanistan, even before we invaded. SO therefore they cannot legally field an army. We are being far more human than these prisoners have any right to expect. I say all this knowing that my unit, and myself have sent people there. Also it's a lot better than what they would get form the Afghani government, especially their NDS, the local version of the CIA.
