Actually, wrong.

There are things that a local government (or any government) is not
allowed to do.

One of the main tenets of this whole system of government is EQUAL
PROTECTION under the law.

The government has a duty to treat us all equal under the law unless
it can be shown there is an overwhelming state interest not to.

What again is the overwhelming state interest in forbidding people to marry?

It seems to me it is exactly the opposite. There is a strong interest
in encouraging marriage. That is why there are all kinds of incentives
to encourage marriage. The arguments by the "family values" folks are
correct in my opinion. Families are better for society than a group of
unconnected individuals. Where they get it wrong is so narrowly
defining "family".
