Worse yet how he is being treated is worse than what Americans who served
with the German army in WW2. There is no evidence aside from association
that he engaged in any actual actions against American forces. Moreover he
also stated that he was given a basic choice, go through martyrdom training
and attack the US or US interests or serve as a foot soldier for the
Taliban. Obviously he chose to serve as a Taliban soldier. While he can be
convicted for serving in a foreign army (yes its illegal for US citizens to
do such), I do not see how he can be convicted of aiding and abetting a
terrorist organization, since he was with the Taliban (the government of
Afghanistan at the time) and not a part of Al Queda.
