which NYT stories on top-secret programs? Are we talking about the financial 
tracking program? If so I have not read them but off-hand I would say First 
Amendment. The other hand is potential harm to this country and eh, if al_Qaeda 
doesn't already suspect something of the kind is happening, they are pretty 
stupid. 

In other words, in this particular case, the public right to know outweighs 
what I see as a rather small potential for harm
