The commander of the New Mexico National Guard has called for
the removal of the Army's inspector general, saying the Army's
investigation into the partial strip search of a New Mexico unit in
Kuwait last year was a "joke."
About 60 members of Task Force Cobra - a unit drawn from across New
Mexico - were forced to strip to their underwear last May as a
military criminal investigator searched them for gang tattoos. He
didn't find any, guard Adjutant General Kenny Montoya said Sunday.
The search followed an unfounded claim by a Wisconsin soldier who said
he was showering near a Hispanic soldier when he noticed the soldier
was tattooed with Chicago-area gang signs, Montoya said.
The Hispanic soldier was not from New Mexico, and Montoya said the
Army has never explained why a report about a non-New Mexican with
possible Chicago gang tattoos led the investigator to the New Mexico
unit. He said the search amounted to racial profiling.
"I believe they were searched because of their last names," he said.
Montoya said he learned of the search from members of the unit and
demanded the Army call off a second round of searches scheduled for
the next day, which it did.
But he said a follow-up investigation by the military found the
criminal investigator had not acted illegally. Montoya said he'd been
unable to learn whether the agent had been disciplined.
"The investigation - truly, it was a joke," he said. "The facts are
there. They've never answered why was this the only unit searched."
Montoya said the Army tracked down the soldier who supposedly had the
gang tattoos only after the New Mexicans were searched. That soldier
didn't have gang tattoos, either, he said.
He said the Army should have issued a formal apology to the New Mexico
soldiers, but hadn't, and said several "top leaders shouldn't be
there" as a result of the search, including Lt. Gen. Stanley Green,
the Army inspector general.
"In the Army, if you apologize, it means you take responsibility for
something," Montoya said. "Somewhere along the line, general officers
forgot that's part of their responsibility."
Task Force Cobra, which included about 190 guard members from various
units, provided security for military convoys in Iraq, Kuwait and
Qatar. It was deployed from November 2005 until November 2006, Maj.
Ken Nava, a guard spokesman said.
The search occurred after the unit had returned to Kuwait from a stint in Iraq.
Montoya said he waited until now to go public with the search because
the 90-day window in which the task force remained under federal
orders has expired.
But Montoya said his own career progression in the Army has been
effectively ended by his complaints over the incident.
A colonel by rank, Montoya has served as adjutant general of the N.M.
National Guard since 2003. The adjutant general, which is not a rank,
is appointed by the governor.
The Army blocked Montoya's promotion to brigadier general in 2004. He
said he was cleared of any wrongdoing in connection with a 2005
flyover by Air National Guard F-16s at the grand opening of a Roswell
Toyota dealership, which coincided with Veteran's Day.
Montoya said he authorized the flyover at the request of state Rep.
Dan Foley, a Roswell Republican, believing the flyover was for a
Veteran's Day celebration.
Montoya said the Army Inspector General's Office aggressively pursued
its investigation of the flyover.
"Instead of being over here looking for some flyover, they should have
been in Kuwait protecting New Mexico soldiers," he said.
