I believe the overtime after 40 hours is a federal rule. But whether vacation and|or holiday hours count toward this total is probably a state by state and|or company by company choice.
Apparently until recently, here at the State of California they would have counted for me. Governor Schwarzenegger has recently proposed to change this so that it they don't count toward overtime totals as a cost savings proposal.
