A contract is the end result of the process. The process is the interesting part. Every employee still ends up having a contract with the company they work for. How that contract comes about, who negotiates it, how it is enforced...those are non-trivial issues and the ones in question here. A mandatory obligation to give a group a chunk of your paycheck is not "just a contract". It may be part of a contract but the inclusion of that part of the contract and all the issues surrounding are not "just a freaking contract".
