Any time a person skin color comes into play, it is not biased.  I
would argue that affirmative action makes competency less of an issue
than skin color.  Going back quite a few years, the NYFD was accused
of discrimination because there was a disproportionate number of women
who failed the physical exam  (not checked out by a doctor, but the
test to determine if a person can physically do the job of a fireman
such as carry hoses up a ladder, carrying a dummy to simulate a human,
etc..).

What was the proposed solution? That the women needed to pass a
different, less stringent test so that ore women could pass. That
makes no sense to me, and puts people's lives in danger.

If you can't do the job - whether its because of physical or
intellectual reasons - you should not get the job...period. The color
of your skin, to be an including or excluding factor, should NEVER
come into play. If it does, its discrimination any way you slice it.
