+1 to everything that Sandy said. The legal framework is still
basically the same as it was 5 years ago, but vendors have improved
substantially in their standards adherence and the burgeoning market
in mobile devices has pushed flexible design to the forefront.

While you might be able to avoid a lawsuit if you don't do the
accessibility work upfront, I'd say that specifying WCAG 2.0 AA in the
RFP will help quickly weed out the crap designers which is a bonus
even if accessibility isn't highest on your todo list. You'll, at the
very least, get people who actually think about their design process
and actually test it at the end. So I'd say it is a win-win.
