I've been on the train for a while now. I have been on this debate for a
long time.

Maybe you should look back to a few things yesterday, the question that was
the most prominent from yesterday was whether or not it was a public place.

I showed from respected legal sources that the law does consider it a public
place as it grants access to the public.

Then the question came up as to whether or not that is definition is
correct. I claim that it is correct, and I offered my reasons.

You brought up the warranty concept, however I pointed out in response to
something Dana sent that the implied warranty is still a law, it comes from
truth in advertising and other standards. There are implied warranties with
products because there are advertising laws. A product must perform as
advertised. Court rulings have concluded that commercial advertising does
not fall within free speech protection and therefore can be regulated and
enforced.

For example: The government has laws regarding cigarette and alcohol
advertising; they affect how private businesses run their companies in
respect to perfectly legal practices.

The government is in place to serve the public, if the public wants a way to
ensure they can go out to eat without having to worry about getting sick,
then they have the ability to pass a law ensuring that chicken must be
cooked to 180 degrees Fahrenheit.

Many restaurant owners don't have a problem with it. Is everybody familiar
with the company Applebees? That restaurant chain, along with many many
others, started in Lexington. The owner of Applebees is also our vise mayor
and has a vote in our city council. He is also republican best I can tell,
our council and mayor elections are non-partisan. He voted for the
resolution.

This is a fairly conservative town, gun ownership is high, everybody has an
SUV, Big democrats haven't come around here in a while. We are a big small
town. So the liberals taking over argument doesn't fly here either.
