The last time we (medical records department) checked (mid-January 2004) our FI (Empire Medicare) was still telling us to continue using the old denial letter form.  I had talked with them in late 2003, when this issue first came up, and I was told by the FI that, "We do not know anything about the SNF ABN forms."  They said that we should keep using the present forms (denial letters) until they (FI) tell us otherwise. It would make sense that using the SNF ABN would have to be acceptable, but isn't it the FI who decides whether you are complying?  Based on that, we are going with what our FI is asking us to do.

I recently heard that the revised mandated CMS denial letters were pushed
back to Oct 2004 for initiation. Can anyone confirm this. Originally I
thought it was Oct 2003. Are these the same paragraphs that you are
referring to?
