IMO, the Adobe code is a third-party work as defined here: http://www.apache.org/legal/src-headers.html#3party
The Adobe code would not be a third-party work if there was an agreement with DP giving DP rights. But once there are significant modifications, it appears we may need to consult legal-discuss for their thoughts.
