You could use the fbx_savecontent.cfm file the code for it is below:

<cfif not thistag.HasEndTag>
        <cfset thistag.generatedcontent="">
        You must have an end Tag
        <cfabort>
</cfif>
<cfparam name="attributes.variable" default="fusebox.layout">
<cfif thistag.executionmode is "end">
        <cfset "caller.#attributes.variable#"=thistag.generatedcontent>
        <cfset thistag.generatedcontent="">
</cfif>

Just put this into a custom tag and use it like this:

<cf_yourtagname variable="content">
        Your file fields here
</cf_yourtagname>

Should do the same as cfsavecontent

yes... although only on 4.5 so will have to use something other than
cfsavecontent.  but that might work.

also, disabling any blank fields didn't work. one thing is that the form
doesn't necessarily have any file fields in it, but the enctype is still
set to allow them. this i think is causing the problem, as removing the
enctype allows the form to be submitted. i think i'll have to check if my
list of fieldnames contains a file field, then decide if i need to set the
enctype or not.

failing that i'll go with this method 1.

you could do 1 if you did this:

<cfset filefields = "">
<cfoutput query="getFields">
     <cfswitch expression="#getFields.Fieldtype#">
          <cfcase value="Text">
               text field
          </cfcase>
          <cfcase value="File">
                       <cfsavecontent variable="thisfield">
                               Your file field code.
                       </cfsavecontent>
              <cfset filefields = filefields & thisfield>
          </cfcase>
          etc
     </cfswitch>
</cfoutput>
<cfif len(filefields)>
<cfoutput>#filefields#</cfoutput>
</cfif>
