I think (not really my area) that "Inspire" (the new EU rules on spatial data) is generating all sorts of thinking about datasets (access & license) alongside infrastructure. The implementation part of it is called the location programme : http://www.defra.gov.uk/location/
Sorry if this is old news, but I've been lurking for a good while. I mention it because some of the options being considered as standard bearers for the project are quite similar to this idea for common land.
