I think the original RSP should certainly be notified when a domain is
transferred, either to another RSP or to another registrar. (I've never
dealt with this situation, so I have no idea what the current behavior is.)
I just don't think the RSP should have a lot of say in whether the
registrant can move the domain to another RSP.
The RSP is not necessarily the maintainer of the domain's name servers,
although I suspect that will be the case most of the time. You run into the
same problem if a user simply changes the name servers for the domain. It's
up to anyone doing this to notify the keeper of the old name servers so that
the zones are removed. Does the OpenSRS system currently email the domain's
tech contact whenever the domain's name servers are modified?
