They've also "lost" domains during that process.

Races.com was registered legitimately through register.com after NSI
deleted a domain name as a part of a RNCA transfer process, but hadn't
processed the new registration.

And under the RNCA agreement the parties have to agree to, NSI is not
responsible for anything if that happens.
