I think what you are suggesting here is an action which *prevents* and
*impedes* international trade -- I believe this is a criminal offense, if
I'm not mistaken... I mean if it is a criminal offense to impede trade
between states, surely this is a much larger issue.

Well, register the trademark in Canada, and you'll have no problem
registering it, even without having a Canadian presence.
But, if your trademark is not in use in Canada, you really don't deserve
to have a .ca name for it, and perhaps a Canadian would have a better use
for the domain!

I'm not sure what Quebec gaining their independence has to do with CIRA
having the .ca -- the only thing we would expect from such an occurence
would be for there to be a .QC TLD, which I'm sure would be well sought
after by all those lawyers in the British Commonwealth that have the title
"Queen's Counsel."
I don't mean to build up CIRA -- many of their policies for the .ca names
are irritating, at best. However, their Canadian presence requirements
are well thought out, allowing full access to the domain to the people it
was intended for: Canadians.
