I didn't hear any legal implications of this mentioned, but just add a
paragraph to your registration agreement.

How often do the hostnames of the nameservers change, though?  Usually
it is just IP address changes, and you don't need access to modify
the individual domains for that, you just modify the hostname record
itself.  Even if you do have to change that nameservers' hostname, it
will still update them when you modify the nameserver to the new
hostname.

If it is more complicated than that, then you just create the subuser
automatically.  It's really not that hard to do.  Just disclose to the
registrant that you are doing that, and what it means.  If you need
help coding it, hire me or one of the others here who do
customizations.

Provided you inform the registrant, there are no other legal
complications, and probably a lot less of them than the plan you
suggested, really, where you just have that right by default to make
changes, even to the nameserver records, without the expressed consent
of the registrant.
