As ICANN will tell you, its not their job.  The registry is suppose to
provide inforcement of contracts, but guess what, Verisign runs the
registry.  What are they going to do, slap their own wrist then continue
on with business as usual?

P.S. your issue with legacy registrations is a little bit different than
the current situation.
