No, it isn't.  A domain is the way you REACH a site.  It's not the site.

If someone STEALS a personal site, that has no value, but a BUSINESS site, is YOUR INCOME.

And if WorldsGreatestStore.com gets stolen, if they do their customer contact right, they can continue the next day at SchmoobleFart.com with nary a glitch.

They stole his/her Business(domain for doing business), and they broke ICANN's policy in doing so. Therefore, it don't matter what their Agreement is, they have to abide by ICANN's rules, GRANTED, they don't always, but they cannot make an Agreement, which breaks ICANN's agreement they agreed to, it won't hold up in a court of law, that I do know.

And those rules say they get reimbursed for the registration.  Period.
