At anytime during those 45 days, the registrar can tell the registry, okay go ahead and delete the domain, and the registry will delete it. This could occur on day 1, day 45 or any day inbetween. The grace period is for payment only, not to be able to retrieve the domain after the registrar has given the go ahead to delete it. As I see it, the system worked as designed. Tucows said go ahead and delete the domain 40 days after expiry and it appears the registry did just that.
