Frankly, if there is any evidence that the domain was renewed, and no adequate
statement to the contrary was given there are really only 2 recourses:

1. Give the back the domain, and compensate for any degradation of its value,
and loss of income.  A ???? farm, objectionable data, or really bad 
site/business/reputation/spamming/etc...
 Can make a domain worth millions very expensive for the new owner.

2. Give them a similar domain, and pay for the advertising, and lost business,
and lack of value/customer loyalty.(You can never fully recover referrals
in progress, affiliate links, offline advertising, third party advertising,
etc...)

To be quite frank, I think VERISIGN should pay for this, because:

1. THEY control it.
2. THEY instigated rules encouraging the early deletion of domains by registrars.
 (Tucows said this happened because they deleted 5 days early to allow for
a connection problem covering 5 days.  They said this was an issue as they
would have to pay for the renewal.)  I hate to say it, but such practices
are common, reasonable, and understandable.
3. THEY didn't honor the maximum grace offered.

It would have not hurt them AT ALL to hold it for those 5 days.  In effect,
they are giving the owners of a domain FEWER rights concerning that domain
than registrars.  ALSO, they probably honor the full 5 days in THEIR case,
as they have no payments or connection problems to contend with.  That isn't
fair to the other registrars.
