These are good questions. I think it makes sense to have Flash emulate the structure of HTML pages, because they are still the best form of navigation we have.
I have never liked Flash for the reason you mention, namely that it's a closed platform from a notoriously flaky company. Open standards, or de facto open standards, are much better.
