How will a receiver distinguish a legit mail resent via a mailing list ( spf fail & dkim is broken by the listserver, equals to no dkim at all)

1: spf will have to be whitelisted on RECIPIENT mailserver if there is any mails that is forwarded, this is usely safe since forward ip is known to forward, in spamassassin add this ip as trusted_networks, then spf works !

from a forged email from a spamsender
( spf fail & no dkim signature at all)

2: dkim ask maillist maintainers either to remove dkim keys, or make sure body content is not changed, perfekt if thay are dkim compliant not breaking dkim at all, try postfix maillists as a working example that works

I am also in the role of a receiver.
How do I reliable identify mailing-lists? Where is a definition?

see list-id header and harden it with precedens header
