Good point, but I'd bet you could get around that since the recorder was
in the opposing party's custody or control.  (Evidence issues are
actually pretty interesting -- you can figure out how the system is
intended to work and the kinds of hacks people have tried to play, based
on the rules that have been put in place.  The rules aren't great, but
at least they're mostly written down so you know how you have to play
the game.)
