The condition arose when housewive(s) in panic mode absolutely confused brake and gas pedals in emergencies (possibly complicated by cruise control speed regulators). USA lawyers managed to hype this into a huge case for which VW/Audi decided an out-of-court quick settlement was better than a lot of adverse front page publicity for a protracted period. (Kinda akin to the notorious flames already pre-lit by CBS's 60 Minutes for their GM? pickup truck gas tank fire crash test). Said Audi condition could not be duplicated, and anyone who understands automotive systems well would know that it would be extremely difficult to replicate a figment of the imagination (these were pre-fly-by-wire days, using mechanical throttle linkage). Under the American legal system you often lose, even if you win--and vice versa.
Justice and law are purely subjective everywhere, and its adjudication and dispensation purely a function of power and money in that order (preferably both). Personal injury in USA can get you well over $100,000,000 if you get burned or smoke too much, but nary a rupee if you live in Bhopal.
