Although I don't dispute this point of yours (I agree, the dock can get 
cluttered, thus why I like my tabbed windows in OS 9)... but there are 
markers to designate what the status of the different items are.

Items placed in the dock are on the left of the divider bar.

Running items placed in the dock are marked with a triangle below them 
(regarless of if they have open windows or not, if the item is launched, 
it has a triangle).

Minimized items are placed to the right of the divider bar, but to the 
left of the trash can, items added are always inserted as the last item 
to the right, before the trash can, which always maintains its position 
as the far right item.

And that of course brings me to the one thing I DISPISE about the dock... 
the fact that the trash can is in there. It means that in order to throw 
anything away, I always have to stop and think about where is the trash 
can located at this exact moment. Because it always stays as the far 
right item, it moves closer and further from the center of the screen 
based on how many other items are in the dock. Who the HELL thought THAT 
was a good idea... I just want my trash can back in the stationary 
position of bottom right corner of my screen!

(See even us people that like OS X know there are certain features that 
suck ass)
