I'm assuming you relate to EMC.

I don't know the French rules, but the UK is subject to the 
Electromagnetic Compatibility Regulations, Statutory Instrument 1992 
No. 2372.

Regulation 28 states that 'No person shall supply..." and refers to 
Reg. 30.

Reg. 30(d)  states that 'The manufacturer has properley issued an EC 
decleration of Conformity....'  Note the past tense in 'issued' 
implying that the certificate must already exist.

Under the UK regs, there is no strict requirement to test under the
Standards route, so the second point you raise is not relevant in UK
law.   The point being that under EC rules, if the CE mark is
applied legally in the UK, there is a 'presumption of conformity'
and the French must allow it in. 

Under the Technical Construction file route, the file must have been 
present for the Competent body to judge.  This file however need not 
be kept as a singular entity, but must be produced within a 
reasonable time - currently the feeling is that that means two 
working weeks or so.

Having said that, the customer can demand what he wants I suppose, 
but those requirements are outside the scope of the question.
