I cannot say that I've read every reply to your request, but I wonder if
you've heard from a good cross-section of EU member states?

Although the Commission are trying to get all Member States to act with at
least some semblance of uniformity, the fact is that some countries within the
EU prefer a 'light touch' (they don't like to call it reactive) whereas others
are more 'proactive' (they don't like to call it heavy handed).  Certainly,
the UK adopts more of a 'complaints driven' approach to market surveillance
and companies are likely to be 'invited to do the right thing' prior to a
prosecution being brought.  

For product safety it is the Scandinavian, Austrians and Southern European
states that seem to report more non-compliant products than, say Germany,
Netherlands or the UK.  I do not have information on the corresponding
situation for EMC, but intuitively would expect Germany to be among the
counties looking to find non-compliant products in a proactive rather than
reactive manner.

Perhaps some of the people who are in contact with the Commission in relation
to EMC matters could say if there is a uniformity of approach re. enforcement
measures following market surveillance (assuming stats. are available) and, if
such data does exist, which are the more active countries as regards
initiating prosecutions.  Presumably it is people from these countries who you
would most like to hear from in order to bolster your case?
