Mark, You have already had most of the information you require, but the point that everybody is making is that if the product falls within Class 1, i.e. operates at harmonized frequencies with other parameters as defined by the relevant sub-class and has been tested to the appropriate harmonized standards, then you do not need the involvement of a NB, and do not have to notify member states. The apparent deviation for France becomes quite clear, as the higher power limit of 100mW is only permitted over a restricted frequency range for all countries. As for the suggestion that it is because of EMF exposure levels, then I suggest that that will depend on whether the product can be body worn or not. In any case, even at 100mW, it is unlikely that field strengths would be such as to require SAR testing. In fact, I believe that the standards that do exist exclude equipment at this power level.
