The Construction Product Regulation (305/2011/EU) is replacing the
Construction Product Directive (89/106/EEC).
Is there a palpable difference between an EU Directive and a
Regulation? Some fewer whereases, but the look and feel is the same.
Yes, profound. Directives have to be embodied into the national laws of
each member state, which means, in most countries, going through a
Parliamentary process, however desultory. But Regulations, prepared by
the Council of Ministers, with or without the European Parliament, are
binding on member states, without any national debate or democratic
intercession.
