Zilch.
Does he personally still hold some responsibility for products and a
company he no longer works for?
Extremely unlikely, unless he was personally involved in a deception.
The Directive is famous for lack of practical thought during its
compilation. Do what you think best, and document it so it could be
produced in court if necessary. You can include a text that explains the
impracticality.
