This is a gross oversimplification of what Mike said, and completely misses
the point, IMHO.  You're placing idealism over realism, and as the saying
goes, "this isn't an ideal world."

What's the purpose of etree?  To facilitate the exchange of live recorded
music from bands who allow their work to be recorded and traded this way.

What could threaten that purpose?  To publicy trade, or to give the
appearance of trading, commerical, non-tradeable/non-recordable music.

The purpose of etree is NOT to illustrate the notion of freedom of speech.
There are other, more effective ways to do that.

As another old saying goes, we don't want to "throw the baby out with the
bathwater."  It would be really stupid to get etree mired in legal
wranglings simply because some fool wants to exercise their "freedom of
speech" by posting ISOs for non-tradeable (and thus OFF TOPIC) music.
