If they were naturally occurring, I'd agree with you.

However, I have yet to see a virus, trojan, etc that wasn't written by a person. That person should be held accountable.

It seems to me as though in this case one could hold the manufacturer of the software liable under the same logic as we have the manufacturers of automobiles that burst into flame under the stress of a parking lot fender-bender.

The fender bender is a foreseeable event. Put multiple objects in motion, and eventually, one will hit another, and that was NOT usually the intended action of said objects.


On the other hand, when a person sets out to gain access to a computer without permission, that PERSON should be held responsible.

In other words, I should never have to lock up my stuff in order to keep it. I should be able to leave money on a table in Burger King, come back later, and find it still there. Granted, in this world, that's not going to happen, but that's how it SHOULD be.

Although we could also hand the ball to network owners who let it spread past their networks.

If I'm aware of my network spewing garbage, then I should be held accountable for not stopping it.
