That is true, but what about the automated threats (virus,worm,webtrojan, etc.)
It seems to me as though in this case one could hold the manufacturer of the software liable under the same logic as we have the manufacturers of automobiles that burst into flame under the stress of a parking lot fender-bender.
Although we could also hand the ball to network owners who let it spread past their networks.
