If you read the case they talk about the issue coming up in the AG
opinions of two earlier cases but it was only finally decided by the
ECJ in February. It was an important issue so he would have known that
the case was due to be decided. The ECJ even got all the MS to submit
opinions before they made their decision so it was a huge case on the
horizon when he wrote the papers.

He did the same with the Metock question last year. It must have been
decided after the papers were written up but it's so important that he
would have known it was coming down the line and asked the question
anyway. Also gives you the opportunity to say how you would argue it
even if you haven't heard about the case.
